Last updated: May 2026. These terms govern your use of MedCare Surgical (the “Site”) and any orders you place with us. By using the Site or buying from us, you agree to these terms. If you do not agree, please do not use the Site.
1. Eligibility
You must be at least 18 years old (or the legal capacity to enter a contract) to buy from MedCare Surgical. Certain regulated devices are supplied only to healthcare professionals, licensed facilities, or against a prescription, and we may ask for verification before dispatch. By placing an order you confirm that you meet this requirement.
2. Your account
If you create an account, you are responsible for keeping your password confidential and for all activity under your account. Notify us right away at support@medcaresurgical.com if you suspect unauthorised use.
3. Orders and pricing
An order is a binding offer to buy. We confirm acceptance once you receive an order confirmation email. We may decline or cancel an order at our discretion, for example if a product is mispriced, out of stock, or shows signs of fraud. If we cancel after you have paid, we refund within five business days.
All prices are listed in Nepali Rupees (NPR) inclusive of any applicable tax unless stated otherwise on the product page. Shipping is calculated at checkout.
4. Payment
Payment is taken at the time of order through our supported payment methods (eSewa, Khalti, Fonepay, card, or cash on delivery where available). You authorise us to charge the payment method you select for the full order amount including shipping and tax.
5. Shipping
Estimated delivery times are shown at checkout. They are estimates, not guarantees. Risk of loss passes to you when the carrier delivers the package to the address you provided. If a package is delayed by more than 14 business days past its estimate, contact us and we will investigate.
6. Returns
Unopened items can be returned within 30 days of delivery for a full refund of the product price (excluding original shipping). For sterility reasons, opened sterile or single-use goods cannot be returned or exchanged. Installed equipment is covered by warranty rather than by return; see our returns policy. If a product arrives damaged or defective, contact us within 7 days at support@medcaresurgical.com and we will arrange a replacement or refund at no cost to you. 7. Prohibited uses
You agree not to use MedCare Surgical in ways that:
- Violate any law or regulation, including export controls and consumer protection laws.
- Infringe our or anyone else’s intellectual property, privacy, or other rights.
- Attempt to gain unauthorised access to the Site, other accounts, or our systems.
- Disrupt the Site through scripting, scraping at scale, denial-of-service attempts, or vulnerability probing without permission.
- Resell our products commercially without our written consent.
8. Intellectual property
The MedCare Surgical name, logo, page copy, photography, and product designs are owned by us or licensed to us. You may not copy, reproduce, or use them commercially without written permission. Customer reviews remain yours; by submitting them you grant us a worldwide, royalty-free licence to display and lightly edit them on the Site for clarity.
9. Disclaimer
The Site and the products are provided on an “as is” basis. We make no warranty that the Site will be error-free, uninterrupted, or free of viruses. Beyond what is required by law, no implied warranties apply, including merchantability, fitness for a particular purpose, or non-infringement.
10. Limitation of liability
To the fullest extent allowed by law, MedCare Surgical is not liable for indirect, incidental, special, or consequential damages, including loss of data, loss of profits, or business interruption. Our total liability for any claim related to your use of the Site or a purchase is capped at the amount you paid us in the 12 months before the claim arose. This clause does not limit liability that cannot be limited under applicable law.
11. Governing law and disputes
These terms are governed by the laws of Nepal. Any dispute arising from or relating to your use of the Site or our products will be settled in the courts of Kathmandu, Nepal, unless your local consumer law gives you the right to bring a claim in your home jurisdiction.
12. Changes to these terms
We may update these terms from time to time. The date at the top of the page reflects the most recent revision. Continued use of the Site after a change means you accept the updated terms.
